Rule 13
Determining the number of posts based on the percentage of vacancies

(1) According to rule 12, after receiving the information related to the demand for employees, the Public Service Commission will determine the number of posts based on the percentage of vacancies to be filled through open competition, evaluation of functionality, internal competitive examination and adjustment of promotion based on evaluation of performance and experience in accordance with section 17 of the Act. > (2) When determining the number of posts according to sub-rule (1), sub-section of section 17 of the Act
According to (1), out of the number of posts to be filled through open competition, the number of posts to be filled according to sub-section (6) of the same section should also be determined.
(3) For the purpose of sub-section (6) of section 17 of the Act, the details of economically and socially backward women, tribal/tribes, Madheshi, Dalit communities shall be as prescribed by the Government of Nepal by publishing a notice in the Nepal Gazette. But until the details are published in the Nepal Gazette, all women, tribals/tribes, Madheshis, Dalits will be considered economically and socially backward communities.
(4) For the purpose of submitting the application for the number of posts allocated according to the sub-section (6) of section 17 of the Act, it should be given on the following basis.
(a) In the case of tribals/tribes listed in the Nepal Adivasi/Tribal Upliftment National Foundation Act, based on the same list, but if there is more than one surname within the caste listed in the Nepal Adivasi/Tribal Upliftment National Foundation Act, listed by the chief district officer on the recommendation of the head of the concerned local body. It should be certified as a surname within the existing caste and submitted along with the application.
(b) In the case of Dalits, based on the same list as in the case of the caste listed by the National Dalit Commission, but if there is more than one surname within the caste listed by the National Dalit Commission, on the recommendation of the head of the relevant local body, the chief district officer shall submit the application as a certified surname within the caste listed by the National Dalit Commission. c) In case of disabled persons, on the basis of proof of disability from the Social Welfare Council on the recommendation of an approved physician,
(d) MadhesiIn case, the Nepal Government publishes a notice in the Nepal Gazette on the basis of certifying Madhesi from a designated institution, but until the organization is designated by publishing a notice in the Nepal Gazette, on the recommendation of the head of the relevant local body, the application must be certified by the Chief District Officer as Madhesi.
(e) In the case of backward areas, permanent residence in the district mentioned in sub-section (6) of section 17 of the Act, on the basis of the certificate of citizenship obtained from the relevant district and the relevant village development committee or municipality certifying that he is currently residing permanently in the same place.
(5) According to sub-rule (1), if there is no candidate for the post allotted to be filled by the adjustment of promotion based on performance and experience evaluation, such post of that year will be included in the promotion post based on performance evaluation.
